Terms and Conditions for ZipWave TV

These Terms and Conditions (”the Terms”) outline the rules, regulations, and obligations that govern the use and the users (”the Users”) of ZipWave TV's streaming service (”the Platform”). They are put in place to ensure a fair, safe, and enjoyable experience for all users.

We may update these Terms and Conditions from time to time. Changes made will be published on this page along with the date where the new Terms go into effect. ZipWave TV’s customer service representatives cannot modify these Terms for any user either verbally or in writing.

  1. Agreement: By accessing this service, we assume you accept these Terms in full. Your use of ZipWave TV's service is conditional upon your compliance and acceptance of these terms. Do not continue to use ZipWave TV's service if you do not accept all of the terms and conditions stated on this page. Your continued usage of the service signifies your agreement to these terms. You must also familiarize yourself with ZipWave TV’s Privacy Policy.

  2. Content: ZipWave TV prides itself in providing a diverse range of streaming content. This includes but is not limited to movies, TV shows, live broadcasts, and other forms of media. Please note that the availability of content may vary based on several factors such as location, subscription type, and others. We strive to keep our content as updated as possible, but it is subject to change without prior notice. We make no guarantees regarding the availability of specific content. A subscription to ZipWave TV does not imply ownership rights to any content provided on the Platform.

  3. Subscription: Access to ZipWave TV's content necessitates a paid subscription. We offer various subscription plans to cater to different viewing preferences. Each of these plans may come with different pricing, features, and access levels. It is your responsibility to choose a plan that best suits your viewing preferences, financial capabilities, and to abide by the terms of your selected plan. The User is responsible for any data charges levied by a telecommunications provider when accessing ZipWave TV. A User must be at least eighteen (18) years old in order to subscribe to the Platform. You consent to receiving information regarding your account via email, mail or telephone, including but not limited to subscription confirmation, payment details or failures, service alterations or outages, password resets and account changes. You may opt in or out of marketing communications. Advertised prices may not include sales taxes or other levies where required to by law. Refunds for the service are not granted at any time after the point of subscription. If you cancel a subscription, access will continue until the date of the end of validity of the subscription period. From time to time we may promote special offers or discounts for a limited period. These are governed by extra Terms and are not valid outside of those Terms.

  4. Payment: We may offer subscriptions granting access to the Platform on a monthly or yearly basis. Please review the product description, cost, applicable taxes, fees, surcharges, usage rules, eligibility, restrictions, features, device availability, and subscription term carefully before purchasing. At the start of each subscription term, the cost plus applicable taxes, fees, and surcharges will automatically be charged to the payment card you provided when creating your Account. When you provide a payment method, our payment gateway provider may verify the information with an authorization hold. This hold does not result in a charge, but it may temporarily reduce your available balance or credit limit. Subscription prices may change, and we will notify you of any changes. If you do not accept the new price, you may cancel your subscription as instructed below. If you do not cancel in time, your subscription will renew at the current price, and you authorize us to charge your payment method accordingly. We cannot notify you of changes in applicable taxes. We are not responsible if any transaction made with us results in fees levied by your payment method provider. You are responsible for keeping your payment details current by updating them in your account settings. If your details change or are about to expire, we may receive updated payment information from your payment provider, including your card number and expiry date. This allows us to continue providing you with access to the Services, and you authorize us to charge your card using the updated information. If a charge to your payment method fails for any reason, we reserve the right to retry billing your payment method. If the payment is not successfully authorized, we may suspend or terminate your subscription. You will remain responsible for any unpaid amounts, including collection costs, bank overdraft fees, collection agency fees, reasonable attorneys’ fees, and arbitration or court costs. Additionally, if you restart your subscription, we may charge your payment method on file. We may apply interest and late fees for any amounts paid after the due date and may terminate or suspend your account if you fail to pay any amounts on time or maintain up-to-date payment information in your account. If subscription payment fails without User cancellation, we may provide a short grace period and alert you to the requirement to update payment details. ZipWave TV may be offered via third parties who sell our services on our behalf in exchange for commission. You may be subject to further Terms and your billing relationship (including payment, cancellation and alteration to subscriptions) is with the third party and not with ZipWave TV. If a third party is offering access to ZipWave TV and you are unsure whether this third party is a legitimate seller of the Platform, you may contact us at support@zipwavetv.com.

  5. Copyright: Unauthorized access, reproduction, retransmission or any other usage of imagery, audio, video or text outside of the service provided by ZipWave TV is strictly forbidden. Any account suspected of subverting this Term will result in termination of the User’s subscription and may be subject to criminal investigation. ZipWave TV is solely available within the United States and accounts suspected of attempting access from outside the United States may be subject to immediate termination without refund. Interference in any way with the Platform, including but not limited to its apps, websites, content or networks, may be referred to the relevant law enforcement and be liable for prosecution.

  6. Account: The User is authorized only to share the account information with members of the same household (”the Household”). You are permitted to install and log into your ZipWave TV account on up to five (5) devices with up to three (3) simultaneous connections. ZipWave TV reserves the right to terminate accounts which are suspected of being used in multiple locations outside of a single household. You are solely responsible for maintaining the confidentiality of your account information. This includes but is not limited to your password, payment information, and personal details. Any activity that occurs under your account falls under your responsibility. If you notice any unauthorized use of your account, you agree to notify ZipWave TV immediately. Please note that ZipWave TV will not be liable for any loss or damage arising from your failure to comply with this section. ZipWave TV may grant Users free trial periods in order to test the Platform. Each Household and/or User is entitled to a single free trial, unless otherwise specifically authorized by ZipWave TV as part of a promotional campaign. Free trials or other special offers may be governed by additional Terms.

  7. Devices: The Platform is available on many types of device, and certain features and content may only be available on certain devices. Questions or guidance about features can be found on our website, or through our customer service which can be contacted via support@zipwavetv.com.

  8. Features: The Platform provides access to various types of content. These are defined as follows: Live TV: Linear television channels which are transmitted as-live to Users via the Platform. Program restart: The ability to restart a program that is already in progress on a live television channel. Some Live TV channels grant additional features, which are described below. Not all channels on ZipWave TV grant all features at all times, and are subject to licensing restrictions. Information about which feature is available for which channel is available on the ZipWave TV website. Certain programming may be blocked from one, some or all of these features even when the Live TV channel generally permits these features. Catch-up: The ability to watch a program that has aired on a live television channel within the last 72 hours. Cloud DVR: The ability to record a program on a live television channel and retain that program on the Platform’s servers in order to (re)watch. The Cloud DVR grants 30 hours of storage to each account, and programs may be retained for 90 days after which point the program is deleted from our servers. On-demand: A selection of static content including but not limited to movies, television series, specials, music and sports. Content may supported by commercials which cannot be skipped. For licensing reasons, the User is not permitted to automatically skip commercials on any content. Additionally, there are other types of content outside of Live TV that may be made available to ZipWave TV Users, including: ’FAST’ channels: Streaming television channels which are provided at no extra cost to paying customers, which are not traditional television channels and may air repetitive content. On-demand: A selection of static content provided by third parties including but not limited to movies, television series, specials, music and sports. Content may supported by commercials which cannot be skipped. Add-ons: Additional content and services provided for an additional cost on top of the basic monthly or yearly subscription. ZipWave TV may change the features and content available on the Platform at any time. We will strive to make users aware of any changes as soon as practicable. We are not liable for any change made to the Platform and its content and features. Customer Service representatives may, at their sole discretion, provide credits or partial refunds for inconvenience caused.

  9. Your data: ZipWave TV is contractually obliged to provide its content owners with statistics regarding viewership or other types of user behavior. We take your privacy seriously and will not share more data than proportionate and as governed by our Privacy Policy.

  10. Parental control: ZipWave TV strives to create a Platform with content suitable for family viewing. However, ZipWave TV is not intended to be viewed without parent or guardian approval. ZipWave TV is not responsible for the content of each broadcaster which provides its programming to the Platform. As ZipWave TV carries national and international networks whose content includes news, sports and entertainment programming, not all programming is rated and may be considered objectionable to some users. The User is responsible for assessing suitability of the content, and should use all tools provided via the Platform or the devices used to access the Platform, including but not limited to parental controls, profiles, app locks, timers and favorites lists, in order to control access to the content.

  11. Termination: ZipWave TV reserves the right to terminate or suspend your account without prior notice at our sole discretion. This is often a measure of last resort and only happens if we determine that you have breached any of the terms of this agreement. Upon termination, your access to ZipWave TV's services will be denied, and we are under no obligation to provide a refund.

  12. Cancellation: Subscriptions renew automatically at the end of each month or year unless you cancel by logging into ZipWave TV, navigating to your Account page, and following the cancellation instructions. Cancellation takes effect at the end of the current subscription term. You can view your renewal dates in your Account settings. If you upgrade your subscription, the change takes effect immediately, and your Account will be prorated. If you downgrade, the change takes effect at the end of the current term, and you will be billed at the new rate. Switching from one type of subscription to another during your billing period may result in loss of access to your original Service. To stop receiving your subscription, you must cancel it. Your Account will indicate the cancellation if successful. Cancel by 11:59 p.m. Mountain Time on the day before your next billing date to avoid charges for the next period. There are no refunds or credits for partial months or years. Cancelling or switching billing to a third party forfeits any service or referral credits. We may offer the option to pause your subscription. If you do not cancel before the pause period ends, billing will resume automatically.

  13. Changes to Terms: ZipWave TV reserves the right to modify these terms and conditions at any time. We do this to ensure the smooth operation of our services and to adapt to the changing digital landscape. Any changes will be effective immediately upon posting to our service. It is your responsibility to regularly review these terms and conditions to stay informed about updates.
